US trade remedy · Cement and Ceramics
Imports of quartz surface products from India into the US are subject to an antidumping duty order (A-533-889) and a countervailing duty order (C-533-890). The US importer pays a cash deposit at entry, at the rate set for the Indian producer and exporter.
The orders
The all-others rate applies to Indian producers and exporters without their own rate. It is the rate printed when the order was issued; later administrative reviews set new, company-specific rates.
| Type | Case number | Order date | All-others rate at order | Next sunset |
|---|---|---|---|---|
| Antidumping (AD) | A-533-889 | 22 Jun 2020 | 3.19% (cash deposit 1.02%) | 1 Dec 2030 |
| Countervailing (CVD) | C-533-890 | 22 Jun 2020 | 2.17% | 1 Dec 2030 |
Scope
The merchandise covered by these Orders is certain quartz surface products. Quartz surface products consist of slabs and other surfaces created from a mixture of materials that includes predominately silica (e.g., quartz, quartz powder, cristobalite, glass powder) as well as a resin binder (e.g., an unsaturated polyester). The incorporation of other materials, including, but not limited to, pigments, cement, or other additives does not remove the merchandise from the scope of these Orders. However, the scope of these Orders only includes products where the silica content is greater than any other single material, by actual weight.…

When the orders were issued, the rate for exporters not individually named (the "all-others" rate) was 3.19% (cash deposit 1.02%) for the AD order and 2.17% for the CVD order. Rates are set per producer and exporter and change after each administrative review, so the rate on a shipment today depends on who made and sold it. Check the latest Federal Register notice.
The US importer of record. It pays a cash deposit at the AD/CVD rate when the goods enter the US, and the final amount is settled when Commerce completes its review. In practice the duty shapes the price the US buyer can pay, so it matters to the Indian exporter too.
Orders are reviewed every five years in a "sunset review". The next one for quartz surface products from India is due to start in Dec 2030. Until an order is revoked, it stays in force.
